We provide clear legal guidance, fast service, and reliable support from start to finish.
There are many situations where transferring ownership of a property becomes necessary. You may wish to add a spouse, common-law partner, child, or parent to your property’s title, allowing them to share legal ownership. In other cases, property owners may need to remove a former spouse or partner from the title following a separation or divorce settlement.
Title transfers may also be required when a co-signer has been added to a mortgage. Once lender requirements have been satisfied and approval is obtained, it may be possible to remove the co-signer from both the mortgage and the property’s title.
If you need assistance with a property ownership transfer. At Millennium Law Chambers our experienced title transfer lawyer in Calgary can guide you through the process and explain the legal and financial implications involved. We prepare and review all required transfer documents accurately and efficiently to help ensure a smooth transaction.
Ownership Structures
Types of Title Ownership in Alberta
Land ownership in Alberta can be structured in several ways, and a title transfer may apply to any of them whether the property is held by an individual, multiple owners, family members, or a business entity.
1
Freehold Ownership
This is the most common type of property ownership in Alberta. As a freehold owner, you own the property outright the land and everything on it subject only to the rights of the Crown. When most people in Calgary buy a home, this is what they get. It is the most complete form of ownership available.
2
Leasehold Ownership
With leasehold ownership, you do not own the land itself you own the right to use it for a fixed period of time, as defined by a lease agreement. If that lease is longer than three years, it can be registered at the Alberta Land Titles Office to protect your interest. Leasehold properties are less common but do exist, particularly on certain types of land where the underlying ground cannot be sold outright.
3
Life Estate Ownership
A life estate gives someone the legal right to live in or use a property for the rest of their life. Once that person passes away, ownership reverts to whoever holds the underlying freehold interest. Life estates are most often used in estate planning for example, allowing an aging parent to remain in the family home for the rest of their life while already passing the eventual ownership to their children. They are particularly useful in blended family situations where you want to protect everyone’s interests fairly.
Before You Sign
Types of Title Ownership in Alberta
If your property has a mortgage, contact your lender before making any changes to title. Most mortgages include a “due on sale” clause, which gives your lender the right to demand full repayment if ownership changes without their approval. Getting that approval first protects you.
We can proceed with your title transfer without written lender confirmation that is your call to make. But we will always make sure you understand this clause before you sign anything. No surprises.
Procedure
How the Title Transfer Works
Here is what you can expect when you work with our team at Millennium Law Chambers:
1
We Pull a Current Copy of Your Title
Before drafting anything, we request an up-to-date copy of the title from the Alberta Land Titles Office. This confirms who is currently registered on title, flags any existing mortgages or encumbrances, and protects against title fraud.
2
We Prepare the Transfer of Land Document
We draft the Transfer of Land document the core legal instrument that officially records the change in ownership. We also prepare any required supporting documents, such as an Affidavit of Value (required by the Land Titles Office to calculate registration fees) and an Affidavit of Execution.
3
You Come In and Sign
We book an appointment for you to sign the transfer documents in our office. If you are the person giving up ownership (the transferor), we will also arrange for a witness to be present and to sign the required affidavit. We take care of all of this you do not need to bring anyone with you.
4
We Register the Transfer at the Land Titles Office
Once signed, we submit the completed Transfer of Land to the Alberta Land Titles Office for registration. Processing times vary we will give you a current estimate when you come in. There is no way to speed up the queue, but we submit without delay on our end.
5
We Confirm the Change
Once the Land Titles Office processes the transfer and updates the title, we send you confirmation along with a copy of the updated title showing the new registered ownership.
In most cases, we can have your documents prepared and ready to sign within one to two business days of your first contact. Same-day service is available when needed.
Dower Rights and Title Transfers in Alberta
Alberta’s Dower Act gives a married spouse certain rights over a property that is the family home, even if that spouse is not on title. Before transferring ownership of a property that has been used as a matrimonial home, dower consent may be required.
Our team is familiar with Alberta’s dower requirements and will ensure that the correct consent documents are in place before the transfer is completed protecting both you and the other party.
