Technically, yes but it is not advisable. A cohabitation agreement that has not been drafted with proper legal advice, does not involve independent legal advice for each party, or uses vague language is much more likely to be challenged or set aside later. The cost of having a lawyer draft the agreement properly is far less than the cost of a dispute over a poorly worded one.
Q3. When is the best time to get a cohabitation agreement?
Before you move in together, ideally. That way, there is no suggestion later that one partner pressured the other during a vulnerable time. That said, you can still put a cohabitation agreement in place after you start living together it is better late than never.
Q4. What if we decide to get married later? Does the agreement become invalid?
Not necessarily. A cohabitation agreement can include a clause that converts it into a marriage contract if the parties marry. Without that clause, however, marriage may affect whether the agreement continues to apply. We can draft the agreement to account for this possibility from the start.
