Areas of Practice for Family Law
Cohabitation Agreements
A Cohabitation Agreement is created for couples who do not marry under the law but are living together. Essentially it's a contract made between an unmarried couple (cohabitants) that want to live together but want to protect their interests. We can draft contracts for you and determine what rights and responsibilities each person has should the relationship end in the future that choose entitlement and obligations, setting out each partner's roles, rights, and responsibilities.
Prenuptial Agreements
A Prenuptial is a legally binding contract between two people about to get married. It is crucial to pre-determine rights and responsibilities in such agreements and reduces uncertainties. In Alberta, a prenuptial agreement can contain contractual terms that determine how property and debt will be divided during the marriage, but usually in case of future divorce or separation. We can assist you by clarifying who owns what assets and how they are divided. Our lawyers also will make sure the rights of your dependants/child/children are protected.
Postnuptial Agreements
Postnuptial agreements are similar to prenuptial agreements. Our experienced lawyers have the expertise to identify the difference between when the agreement is drafted and when it goes into effect. We will assist you in creating and crafting a postnuptial agreement, also a binding contract.
Separation Agreements
Separation agreements are interim agreements made by separating couples, pending their decision to reconcile or divorce. Parties going through a separation may agree on issues involved in ending their relationship.
Emergency Protection Order (EPO)
An Emergency Protection Order (EPO) is a restraining order against another family member when family violence occurs. Anybody can apply for an EPO. It doesn't matter if you're a child, an adult or an older person feeling threatened. If you have experienced violence and/or threatening behaviour that leaves you feeling fearful, or threatened please contact us immediately, and we can guide you with your next steps. If you feel that your life is in danger, please contact your local law enforcement agency.
Alternative Dispute Resolution (ADR)
We have a dedicated team in finding the right solution to your problem, no matter how complex it is. One of the best ways we execute our responsibility depends on the facts of your case. Our experts may recommend ADR or other services. Many family law issues can be solved through negotiation, arbitration, and/or mediation. Family mediation in Alberta is an interest-based process. It encourages parties to communicate, negotiate, and resolve problems out of court with the help of a dispute resolution officer (DRO).
We provide other ADR services such as:
- Judicial Dispute Resolution (JDR)
- Family Law Mediation
